1. Definitions

Lekker Eatz: The Lekker Eatz app, website and its operators.

Seller: A business or individual offering fast food for sale via Lekker Eatz.

Customer: A user purchasing products from Sellers via Lekker Eatz.

Platform: The Lekker Eatz app, website and related services.

2. Seller Terms of Service

2.1 Eligibility

  • You must be at least 18 years old and legally able to operate a business in South Africa.
  • You must provide accurate business, contact and banking details.
  • You are responsible for complying with all local health, safety and licensing regulations.

2.2 Seller Responsibilities

  • Menu & Pricing: Keep your menu, prices and operating hours accurate and up to date.
  • Order Fulfilment: Promptly accept, prepare and fulfil customer orders.
  • Payments: Receive payments for completed orders via cash or EFT.
  • Platform Fees: A 2% platform fee is charged on all sales, invoiced monthly.
  • Notifications: You agree to receive notifications about orders, payments and platform updates.

2.3 Prohibited Conduct

  • Do not use the platform for unlawful, fraudulent or harmful activity.
  • Do not misrepresent your business, menu or pricing.
  • Do not attempt to bypass the platform's payment or order systems.

2.4 Data & Privacy

  • You consent to Lekker Eatz collecting and processing your business and personal data as described in our Privacy Policy.
  • You agree to keep customer data confidential and use it only for fulfilling orders.

2.5 Intellectual Property

  • Lekker Eatz retains all rights to the platform, branding and technology.
  • You may use Lekker Eatz branding only as permitted by us.

2.6 Termination

  • Lekker Eatz may suspend or terminate your Seller account for violation of this Agreement, fraud or misuse of the platform.
  • You may request account closure at any time, subject to settlement of outstanding fees.

2.7 Limitation of Liability

  • Lekker Eatz is not liable for any indirect, incidental or consequential damages arising from your use of the platform.
  • Lekker Eatz does not guarantee uninterrupted service or error-free operation.

2.8 Amendments

Lekker Eatz may update this Agreement from time to time. You will be notified of material changes and continued use constitutes acceptance.

2.9 Governing Law

This Agreement is governed by the laws of South Africa.

By registering as a Seller, you confirm that you have read, understood and agree to these Seller Terms of Service.

3. Customer Terms of Service

3.1 Account Registration & Security

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may delete your account at any time via the app's settings. Upon deletion, your personal data will be removed or anonymised, but order records may be retained for business and regulatory purposes.

3.2 Ordering & Payments

  • You may browse menus, place orders and pay using supported payment methods (Instant EFT and cash).
  • All prices, fees and payment terms are clearly displayed before you confirm your order.
  • Card payments are processed securely via third-party providers (Paystack).
  • Orders are binding once placed. You may cancel unpaid orders, but paid orders can only be refunded or flagged for issues as per our refund policy.

3.3 Order Fulfilment & Delivery

  • Sellers are responsible for preparing and fulfilling your order.
  • You will receive notifications about your order status (accepted, preparing, ready, delivered).
  • For delivery or collection, please ensure your contact details are accurate.

3.4 Refunds & Issues

  • If you experience a problem with your order, you may request a refund or flag an issue via the app.
  • Refund requests must include a reason and may require review by the seller or admin.
  • Refunds are processed according to our refund policy and may take several business days.

3.5 Ratings

You may rate and review sellers after completing an order. Please be respectful and honest.

3.6 Notifications

The app may send you push notifications about order status, promotions, or important updates. You can manage notification preferences in your device settings.

3.7 Privacy

Your personal data is handled according to our Privacy Policy. We collect only the data necessary to provide our services and do not sell your data to third parties.

3.8 User Conduct

You agree not to misuse the app, submit false orders or engage in fraudulent activity. Abusive, offensive or illegal behaviour may result in account suspension or termination.

3.9 Support

3.10 Changes to Terms

We may update these terms from time to time. You will be notified of significant changes via the app.

By using Lekker Eatz, you agree to these Customer Terms of Service. If you do not agree, please do not use the app.
